Contract Signing Authority

Administrative Procedure 2.405

In accordance with Board Policy GP2: Item #6 d “The job of the Board of Trustees is to govern, not manage, the college and: . . . to fix, and enact governing policies which address. the delegation of powers to the President, the monitoring of those powers, and the evaluation of the President.” 

The Chairperson of the Board of Trustees of Community College District No. 509, with the approval of the Board, may designate one or more persons to have authority to affix their signature to execute any warrant, certificate, contract or any other written instrument on behalf of the District and when the signature of this designee is so affixed to a written instrument, it is as binding upon the District as if personally signed by the Chairperson. 

Whenever the Chairperson of the Board desires to designate a person to affix their signature on behalf of the Chairperson and the Board to any warrant, certificate, contract or any other written instrument, the Chairperson shall send a written notice to the Board containing the position the Chairperson has selected and a designation of the instruments that position shall have authority to sign and the notice shall be filed with the Board Secretary, presented at an official meeting of the Board for its approval, and entered in the proceedings of that meeting. 

All agreements and contracts herein shall be in compliance with all applicable federal, state and local laws, rules and regulations as well as Board policies. Unless other authority to execute an agreement is specifically set forth in a Resolution approved by the Board authorizing the District to enter into a Contract or other Agreement, the following positions only are given authority to execute the named instruments:
